Serving Family Court Papers in State of New York
What happens if Family Court papers aren’t served properly?
If the respondent isn’t served according to New York Family Court rules, your case can be delayed or dismissed. Using a professional process server prevents costly mistakes. In some cases, if your process server is unable to serve the documents personally, a motion for alternative service may be applied. Your process server has to exhibit that proper diligence under case law was made which includes at least three attempts of service on three separate days at least 8 days before the court date.
Can you serve someone outside New York?

Do you file the Affidavit (or affirmation) of Service with the Court?
Not for family court. It is not necessary to hire a third-party to file your affidavit of service for family court. You may simply furnish your affidavit on your court date.
Can Family Court documents be served electronically?
In most cases, personal or substitute service is required. The court clerk can advise you if alternate methods (such as certified mail or electronic service) are permitted by the Court.
